1. The shared parenting calendar
The core provision. Note it obliges each parent to record, which is
what makes the calendar a record rather than a convenience.
The parties shall maintain a shared parenting calendar using FamCheck (famcheck.co). Each parent shall enter that parent's time-sharing days, scheduled exchanges, and the child's appointments and activities within forty-eight (48) hours of learning of them. Neither parent shall delete or alter an entry made by the other parent; a parent who disputes an entry shall record the dispute on the calendar rather than remove the entry. Changes to a scheduled exchange shall be recorded on the calendar, which attributes each change to the parent who made it and to the date and time it was made.
2. Access for a court-appointed third party
The provision most worth having. Access is read-only, carries the case
reference, logs every view where both parents can see it, and any revocation is
recorded under the revoking parent's name and disclosed, so blinding the appointed
professional is itself an act on the record.
Upon appointment, the guardian ad litem / parenting coordinator / custody evaluator / mediator shall be granted read-only observer access to the parties' shared parenting calendar, recorded against case number ________, for a term of one hundred eighty (180) days, renewable. Such access shall be limited to the parenting schedule, scheduled exchanges, child-related events and recorded changes of plan, and shall not extend to either parent's private notes. Each view shall be logged and the log shall be visible to both parents. Either parent may revoke such access; any revocation shall be recorded, identified by the revoking parent, and disclosed to the appointed professional and to the other parent within twenty-four (24) hours.
3. Certified records
⚠ Drafted narrowly on purpose. A certificate establishes that the file was
issued by us and is unaltered, it is not evidence that the entries are true,
because the parents wrote them. What that is worth under your rules of evidence is your
judgment, not ours; see records and legal requests for what we hold
and what we will produce.
Either parent may obtain from FamCheck a certified copy of the shared parenting calendar, being a signed file bearing a cryptographic fingerprint of its contents, the certificate's date of issue, and the identity of the parent who requested it, which any person may verify at famcheck.co/verify without an account. Such a certified copy is offered as a record of what was entered by the parties and when, and not as evidence of the truth of any entry. Upon written request, FamCheck will provide a statement of its records custodian describing the record produced and the manner of its keeping.
4. Cost, and what happens when one party stops paying
⭐ The clause almost every order in this category gets wrong. If the paying
party cuts off the subscription, the other party loses the record, so the second
sentence gives them a window to take it over rather than lose it. Third-party caregivers
are free and always will be, so no order needs to allocate their cost.
The cost of the shared parenting calendar, presently $9.99 per month for the household, shall be borne by ________ / divided equally between the parties. Should the paying party discontinue payment, that party shall notify the other party and the account shall remain available for seven (7) days, during which the other party may assume payment and retain the record. No cost shall be allocated for access by third-party caregivers, babysitters, relatives or other persons with whom the parties share a day, such access being provided at no charge.
5. The disclaimer to keep in the file
Recital language that protects the professional who recommended us. We
would rather you file this than have anyone later argue we were held out as
court-sanctioned.
The parties acknowledge that FamCheck is a private service selected by agreement of the parties and is not approved, certified, endorsed or supervised by this Court or by any court, and that nothing entered on the shared parenting calendar constitutes a finding of fact by this Court.
